Well, that most definitely depends on each game's particular EULA but especially considering how meaningless this particular checksum is and unsuitable it is for identifying individuals I don't see the slightest chance that it's not covered by it. After all, there's tons of data you often agree to share with the developer/publisher when you play their game and especially use their client like Steam or Origin. With these clients you usually agree to openly send data about your OS, drivers, hardware etc.. An outrage about this checksum (which AFAIK cannot even be used to reconstruct your exact hardware configuration) is ridiculous by comparison.
