I think that is caused by EoC being installed in the %:\Program Files% directory, try running it as admin or install somewhere else.

Edit:

And don't install the patch over the gog version, it will enable the copy protection.

I have the original DVD issue, I installed from that. And I've installed directly to a directory on a partitioned drive, does the game _haveto_ be installed on the C:\ drive?
The game doesn't have to be installed on C: I installed my copy on D:

Iwar2player: Look here and install the F14.6 patch. This will give you in game menu options (among other fixes) that should enable DX8. This is in addition to editing the flux.ini by hand also detailed elsewhere (It's simple).
