It was built on the source code obtained directly from Toys for Bob. The game is a port of the 3D0 version of the game which was superior to the PC version. Toys for Bob wasn't interested in porting it, but gave the team the source code to do it themselves. So, it should be legal.

Oh man, that's sad.

I've read the blog post and see that they claim that Atari shouldn't have been selling them here even before Stardock supposedly bought the rights. I wonder why they didn't dispute this back when Atari was selling them here?

Either way, I had been under the impression that Ghosts of the Precursors was being made with the permission of Stardock but it sounds like from what Fred and Paul say Stardock pretty much only owns the name. This does explain why the Ur-Quan Masters exists, the game itself was Fred and Paul's to release but the name was at the time owned by Atari, hence the change to UQM.

I hope this finds in Fred and Paul's favour and the original games can come back here by mutual agreement.

Maybe bored lawyers on either camps (or rather Stardock) sent pre-emptive C&Ds without bothering to check out with the companies?

Wasn't there a case like that a few months back where a Disney artist got a C&D from a Disney lawyer for having art looking too much like Disney works?
such a shame. the legal system is also a shame as to why it takes so long for cases to be resolved

Actually, the 3DO port was made by Crystal Dynamics and a lot of the assets belong to them. They probably never did anything about it since no money is being made or they never heard of it.

Those assets don't come with the UQM by default as far as I'm aware. The FMVs must be provided by the user if they want them. The 3DO source code probably continued to belong to TfB I guess as it's a derivative work.
