Not really, Germany is quite tolerant when it comes to nudity. Quite a few 'naughty' games come from Germany and were sold openly in the stores back in the days:) Biing, Wet/Lula - The Sexy empire are famous examples (where the posters and ads for "Wet: The Sexy Empire" had to be changed. In the first draft her middle finger was ... "hidden" and in the third version of the cover they put the director's head in front of her private parts). And fun fact: These games are only rated 16+, and are still treated as adult games on GOG. Visible boobs or other parts in Germany don't necessarily mean it's adult content. Playboy magazines can be found in magazine shops on ground level, ready to picked up by milk hungry toddlers with the according strength.
No, it's a legal thing. Other than in the US for example, in Germany the USK rating is not just a suggestion, it's binding (for the trader. What parents do is another story).
And for some time now they also demand proper age verification. When you order a 18+ product from Amazon, you have to be at home to receive it, holding your papers ready. GOG would have to implement a verification system and that would mean very high costs. But then again, in theory GOG would have to do that for all games, including all the violent shooters which are subject to the same laws. There is no legal distinction
why a game was rated 18+.
Only when a game was put on the BPjM index (doesn't happen as often as people think, but it happens), you must not put it on display openly and are not allowed to advertise it. But you can still sell it after proper age verification.
What GOG does here, is a sign of goodwill, hoping that lawyers and parents will look away. But legally it means nothing. They already don't follow the law as it is.
