What GOG is doing here (as I see it) is actually pretty great, I think. And I hope German users realise the chance they are being given.

dx1: As far as I know Commandos 2 and 3 were never on the index of the BPjM. If it was there wouldn't be loads of copies be offered for sale at the German marketplaces of amazon and ebay.

It is great because they offer indexed games? Steam does that too but Steam doesn't consider itself as DRM-free.When it comes to GOG their text about DRM-free, all yours bla bla is now misleading.

That's because only the censored version was sold/distributed in Germany. You can look up at ogdb.eu.

But why? Developers themselves suggested this for this particular one game i mentioned above, at least. And no lies; pirates do have honor, matey, now, now... In cases like this, no one kills anything, but us helpful community members, kill the censorship and oppression enforced. Like in the real age of pirates, smugglers are here to cater to the needs of the community, and what's best, this is for free! Enjoy!

And don't misunderstand me either. I will buy those games, too, like i did with Hotline Miami 1, which i GAVE away. So don't be quick to judge, please.

So what? It could end up on one the lists of THE INDEX ♪dum-dum-daaa♫ or no one ever cares. It's not an automated process that goes like "symbols of unconstitutionally organisation? → ban the game". As long the game is not rated it's just for people who are 18 years of age or older and the Sword of Damocles hovering over the legal right to sell copies—nothing more. And if it get's "banned" by a law court or listed on the index, it will not render prior sales illegal or something like that.

I know, but take for example F.E.A.R., which was also sold/distributed only in the censored version in Germany. The uncut version got indexed by the BPjM, but GoG is still selling this atm without regionlock.

I suppose that there are no real legal consequences to fear as long as these two titles don't get indexed/seized.

I have no problem with people downloading stuff they can't buy or that they have lost access to *cough*, more with the petulant childish attitude of lala, I don't have to pay, I'm so smart. It's hard to tell the two apart depending on how persons express themselves.

Yeah walking around with ten ounces is dumb as shit, the only Colorado one I know of was the guy growing on federal parkland which is obviously verboten.

These type of restrictive laws usually apply to the point of delivery, not the point of sale.
It's a shame, really, my dad has been in so much pain from an arthritic back and bad hips that I'd love to be able to buy him some medicinal marijuana, of course I'd have to convince him of the efficacy and the non-addictive properties first, he is of the old school.
