Are you 100% sure that it's not the EULA for the AMD drivers you have been reading?

Positive.

When it appears, the clause is included in the GAME'S EULA because it installs the driver without giving you the choice of opting out.

It is specifically in a paragraph named "AMD CPU Drivers" which I find no other probable way of explaining than that it would refer to the drivers and not the game as the game is not the property of American Micro Devices... There are similar headlines for the UDK and for The Ball where the EULA for those pieces of software are written. The fact that it installs the driver seems to me more to be a question of bad programming on CDPR's part...

[Edit] BTW I have just checked my installed programs in my control panel and the AMD driver isn't listed. So it might start the program. But on my computer at least it doesn't install anything.

I have an AMD CPU and GPU and when I install The Ball via Galaxy, it attempts to install some kind of AMD UDKEngine driver or something, which crashes during install claiming a corrupted download. I have not downloaded anything however, I am installing via Galaxy and it does this every single time. No problems with any other games, and it is not a problem with my computer but very clearly some bug in what GOG is providing via Galaxy. I've filed a support request for the issue so they'll likely respond within a day or so.

This isn't related to the original poster's comments however side-related to other comments so I thought it would be useful for others that stumble upon this thread having a similar issue. I may post back the results I get from GOG if I think they're useful.
