I doubt Steam is modifying the game, they probably just updated it with what Night Dive Studio's gave them.
Now let' see if Steam takes the high road
Bet steam isn't involved with the files of the game, it was probably Night Dive that did it.
well, if night dive did this, then that would be a really crappy thing to do, as this would be the second time they would have done it, and this time willingly.

You know, I was trying to come up with some sort of potential justification for Night Dive, but I really can't. I would have a hard time believing Steam would bother patching. And if it really is v5.1 then you can't even say anything like it was an old build or slipped through by accident. Almost blatant enough to think it's an F.U.
there is a big fat acknowledgement on the night dive webpage, but I'm still not aware of them having a permission to use the tool as they see fit (that's why the current GOG release only uses NewDark, no tool).

Steam has a variety of dated titles and modern ones. Many. Why should Steam opt out of adding this game from their system just out of kindness towards their competitors? Do you even know how running a business works?

If I would have writing my comment from the assumption that gog has exclusive rights I would not have said "ass" I would have said "illegal".

Ill repeat myself:
Steam has a very comfortable position as it is and it sells new games (plus pretty much the games from when it started) and a lot of indie titles.
GoG good OLD games is all about the older titles and making them available again.
Sure they sell some new stuff and honestly, apart from the Witcher games (which are their own) I do think most of it is misplaced (some indie titles not so much as they look like older games).
It is a business sure but that is not the same as being an ass, Steam does not need these titles to make a money at all, they are but a drop in their ocean, where with gog its quite a bit more important.
I see it more as killing competition then anything else.

That's not actually relevant since they're making money off it, even if the main fault is Night Dive's. "We didn't know, honest guv" didn't get much traction for MegaUpload and a long trail of others.

Consider a situation where the soundtrack had been replaced by Rihanna and Justin Bieber mp3s. Steam would still be in trouble for distributing and profiting from them, protestations of ignorance notwithstanding. Of course it isn't Rihanna/ Bieber, and it may just be some bloke who wrote a compatibility program complaining rather than Universal/ BMG/ MultiNational's high powered suite of lawyers- but the principle is the same. And it's not like it's a one off, it's been done twice.
If something was illegal, Steam would just take it down (after obtaining the cease and desist letter or being told to by the publishing company who had a lawsuit brought against them), and suspend the sale of it until the lawsuit was cleared up.

It's hardly anything like megaupload where people were doing things intentionally illegal.

I'd say your analogy is hardly comparable.

Fact is steam has had issues like that in the past, and have suspended the sale of games when the company publishing had legal issues to contend with, and had to ask Steam to suspend the sale.

Such as when Sony had lawsuit against Rockstar.

Hell, even GoG has had to remove games when licensing issues between a game's publisher and some other third party holding rights to assets/ip cropped up. XIII for example.

Not true as Steam doesn't sell games. You pay for the right to play games on the Steam platform, you do not own them and you can't run them without Steam. They can even legally lock your account and you'll no longer be able to use the games you paid for. It's just a service.
"In the unlikely event of the discontinuation of the Steam network, measures are in place to ensure that all users continue to have have access to their Steam games."
Nobody knows what those measures will be... And since Steam is going strong it isn't likely to happen any time soon, if ever.
do note that the steam version is also DRM free. once downloaded, you can do anything with it - move it around your hdd, copy on a thumb drive, etc..

A very CHILDISH and ignorant argument still.

Just as GoG's aims are to bring the best titles to their customers, same applies to VALVe with Steam (this goes without saying, really). You're expecting them to drop the ball on their customers just so GoG can please theirs (out of "respect") and also have a competitive edge over them, yet if they were to do this they'd be disrespecting their own loyal cusomer base, pushing them away . Such a stupid and IGNORANT expectation.

It's not always about competition solely. It's also about satisfying your current loyal consumer base of which Valve have attained. People who slammed you as a "fanboy" are in their right saying so, cause that's what you're coming off as without any sound counter-points.
