I don't know if gog has used warez or not to strip their games from DRM. What it's obvious is that they have to tinker with the code to ensure that everything works properly.

Also if a publisher/developer greenlights a game to be launched into gog that needs to be stripped of its DRM because the publisher/developer can't provide a DRM-free native copy then it's up to gog to find and decide how to strip the DRM. If they do it from scratch or if they use other software already avaiable it's not going to suppose any legal problems since there are no more parties involved and the developer/publisher is aware that gog is going to strip the DRM.

Finally I strongly believe that no question is retarded (Specially if it sparks such a debate), that there's no need to insult anyone and that you really owe the guy an apology.
