ch108: Is it permanently Missing In Action digitally here due to rights issues or some rare issue with modern graphics (i.e. Splinter Cell: Pandora Tomorrow)?
Or something else entirely?
The only thing I can think of is it's tied up at Disney. It was developed by Pandemic and published by LucasArts (2004) well before Pandemic's acquisition and eventual closure by EA. While I couldn't say why it wasn't digitally available before Disney's acquisition of LucasArts, one possible factor now is EA / DICE's upcoming Battlefront game.
It's all pure speculation on my part though. I have no particular insight into any of these companies, heh.
