Ok, so after the fiasco of the past two days I finally found the problem with my constant insta-crashes.
Windows 7 Service Pack 1
Yup, thats it!
I spent the entire day trying this, that and the other to no avail so I finally bit the bullet, repartitioned, reformatted, reinstalled EVERYTHING, still no joy so thought "What the hell" and decided to install GoG Galaxy, but nooooo, it requires service pack 1 (which I already had installed on the previous install of windows but apparently something had screwed with it so it wasn't picked up by Galaxy) so, with nothing better to do I downloaded the iso (crappy goddamned internet, took an hour for the 2 Gigs) then installed it (crappy goddemned installer waits until I hit install before telling me it'll take over an hour, bullcrap, try an hour and a half!! ), then I'm about to install Galaxy but pause and try the game again.......... Well bend me over and call me honey if the damn thing don't work straight of the bat!!
So don't ask me what exactly it was, I would have thought that reinstalling windows, motherboard drivers, graphics drivers, etc. ect would install all the required VisualC redists (as well as the game itself) but it was something in the service pack that did it for me.

Hope this helps at least a few of you, now to explore!-)

NOTE: running an MSI GTX 660 Twin Frozr III which IS NOT Open GL 4.5 (4.4 @ 100%) ready, though 90% which is apparently all you need but if you're on a min spec 480 good luck to you
