i used to have this game on windows 8, and uninstalled it, after that i re installed and its really laggy in the menu, and is almost unusable, could it be my os? anyways any answers/ suggestions will help

I was never able to get it to work on Windows 8. Windows 8 is the problem, due to the lack of legacy support. Also, the publisher probably doesn't have the source code that would be required to recompile the game for Windows 8. Sometimes you can find patches or work-arounds, but I haven't seen anything. You could right click on the .exe and change the compatibility to XP or Vista, that works for some games.
Edit: changing the compatibility didn't fix the problem for me.
