I for one will never buy another gearbox game.

TL:DR

Sega has agreed to pay out $1.25m as it looks to settle a class-action suit relating to the false advertisement of Aliens: Colonial Marines - while Gearbox, which was also named in the claim, continues to fight on. Polygon has the full scoop on the latest twist in the ongoing saga.

Gearbox is not a part of the settlement agreement, having said last month it would no longer take part in negotiations.

"Gearbox never belonged in this lawsuit," read the filing in July. "Gearbox is a video game software developer. It was neither the publisher nor seller of the video game at issue. For more than a year, Gearbox has quietly abided the plaintiffs' claims so that Sega, the game's publisher and the party responsible for the game's marketing and sale, could assume the defense of this lawsuit. Gearbox has honored its publisher's request in spite of plaintiffs' highly-publicized-and highly-misplaced-claims against Gearbox. At this point, however, Gearbox is obligated to pursue its rightful departure from this case."
I didn't play ACM but a friend of mine did on xbox where he got it really cheap and he said even at a tenner he still felt gypped, hopefully Sega will get off with this payment and GB get screwed to the wall for what they did, they seem to have some wiggle room with their defence tho.
I'm unclear on this: What's the central complaint here? I understand it's about false advertising, but what's the meat of that particular accusation?

Short version : They did some footage of the game for E3, and the final product wasn't even near what was featured/promised.
Then ( and people should correct me if I'm wrong), there are allegations that Gearbox misused the funds between different projects, which I think was some kind of excuse for the buggy mess.

Edit 2 : Yes, this is a case where the publisher got a bit fsckd by the dev .... because the dev don't care as he will make its living selling Borderlands X. It on my TODO list to prevent people from buying any future Borderlands.

My understanding is this (trying to be as concise as possible).

Apparently Sega paid GB a lot of money to make Aliens CM, Gearbox hived off a lot of the work to some noname devs and spent the rest of the cash developing Borderlands 2.

When the game was being touted they used a lot of footage that was supposed to be gameplay, but when you actually play the shambolix of a game, you can see that it wasn't actual gameplay footage at all .

That can't be the issue if GB is not involved in this.

Probably just the E3 fabricated footage that was not taken from the shoddy game.

That's a stupidly low settlement. That'd be made back in what, two seconds of pachinko?

Hopefully they lose more with Sonic Boom, too!
