NovaLogic is like 10 years without releasing a game (DFX and DFX 2 do not count for me... seriously),

and now they go suing Activision in hopes of having money to release their Delta Force: Angel Falls new game. And of course, to explore and exploit people who purchase that new product, by charging fees for online play. This makes me sad, I've played almost all of their games back in the day.

Don't know why everyone is hating on novalogic. They seem to have a point, at least on the logo. Doesn't seem right to sue on the "Delta force" name, otherwise they'd have to sue "Black Hawk Down" and Chuck Norris.

And suing Chuck Norris is not going to end well for anyone.

According to wikipedia at least, Delta Force is an actual special forces group, although that's not its official name.
Therefore Novalogic definitely doesn't own the name or logo, and has no right to sue. This seems an even more frivolous lawsuit than usual.

It'd be like EA suing any other football game maker over the use of the FIFA trademark, they'd get laughed out of court as only the actual organization has the right to that trademark.

EA is the only game developer allowed to use FIFA trademarks. if somebody else used it EA could sue.
Logo of delta force might belongs to someone. Furthermore, Novalogic build a franchise around that logo therefore activision might not be able to just use it.

Mmm about FIFA... you sort of right... but FIFA can sell their trademark to anyone they want. And recently EA had some issues with licenses for Euro 2012 DLC for FIFA 12... so dunno.

About the DeltaForce - if NovaLogic are paying for the trademark,they have every right to sue Activision ...

FIFA owns it but as long as EA has rights to use it solely FIFA cannot license it to any other video game producer. therefore if someone else use it EA can sue both FIFA (if they agreed) and whoever uses it.

Even if it is in public domain they can sue. they build a franchise around it, it is not commonly used, while not registered trademark it is one.

EA have the name right for FIFA... not the whole license pack. That is why you can see normal licenses in PES when they pay for them. ;)

Trademarks & name rights in sports are even worse than in games :D
Personally the most "shocking" part of this news is discovering that Novalogic is still alive, I was sure the company died years ago...
Hmm, never played delta force, but did come across it rummaging through a box yesterday at my GF's place (along with half-life, rollercoaster tycoon and duke nukem 3d).

The logos are very similar. They do have a case. And according to stupid trademark law they are actually forced to sue or lose the trademark. Since they want to launch a DF game they really don't want to lose that trademark and the publicity won't hurt their game.
This is just creating hype for CoD from Activisions marketing machine, so what's next: Michael Bay sueing Activision because CoD resembles Transformers too much.
