ROD2k: It's not up to them, they don't own the IP.
To be fair, Disney hasn't (at least not yet) removed Tales of Monkey Island from GOG.com, and that game seems to be in a similar position, being made and released by an outside company, but having Disney owning the IP.

I'm pretty sure LucasArts didn't publish ToMI, they just licensed out the IP for Telltale to develop. Unless Double Fine is licensing the IP from Disney, Disney (or Sony, considering they were the ones who wanted this remake so badly) is going to be in charge of where this goes.
