Probably not. Suppose that happens. It's because of Steam, a security glitch of all things, leaks out your card number, stamps it online. You get hit with a bill for $3000, and Steam is aware of the issue, choosing not to announce the issue for several weeks. That's called Negligence.

Just because we haven't sued a company doesn't mean that we will never. Everything, everyone, all people, all companies, all humanity is imperfect, and there's nothing you can say to make that any different. So is it worth saying "Meh, you won't ever sue them anyway." when you're putting your financial life on the line every time you make a transaction with them, give them information? Bullshit, fucking, bullshit. You trust them, if they fuck up, you deserve for them to compensate you, fix the mess they caused. And don't call my example up there impossible, it's happened to bigger companies.
Sure. But the scenario above could well enough describe gog.com instead of steam. Or any website and service which processes credit card number.

Also in the new agreement it says "This Section 12 shall apply to the maximum extent permitted by applicable law. If the laws of your jurisdiction prohibit the application of some or all of the provisions of this Section notwithstanding Section 11 (Applicable Law/Jurisdiction), such provisions will not apply to you."

That means this changes nothing for me, because I don't think this will be legal in EU. You Americans on the other hand, are probably screwed.

The argument isn't about wether or not only steam is capable of that. It's about the fact that no company should be un-touchable. Immortal. Fuck that, consumers have legal rights. Even if some of them are dumbasses, that doesn't absolve the rights of consumers who have been justifiably destroyed or ruined by poor practice and neglicence. Besides that, someone mentioned that the clause is more of a way to prevent lawsuits in the first place even if it doesn't apply. I could tell a million people the law prevents them from watering the lawn and a good chunk are going to believe it. Despite what you think, it affects everyone, legal or not, and it's already being fought against here by a number of groups.

That's the hope. Besides, someone came up with the bullshit that coorperations are now legally a person, so you can make that argument that no person is excused from judicial persecution.
