I think they just release it as is from the publisher. That would explain the inconsistency.

Keep in mind that these soundtracks aren't always ripped from the CD audio. Sometimes they're ripped from in-game data files. My Tex Murphy: Overseer soundtrack has a few songs that aren't in the GOG soundtrack.

The Overseer one specifically states "in-game soundtrack" though, as do some others.
