SLP2000: And if it concerns gamers all over the world, then it concerns EU gamers too, so it takes place in its jurisdiction.
I can't speak for other EU countries, but here in The Netherlands EULAs are deemed invalid. Not the specific articles which are in clear violation of laws, but the whole EULA.

Anarki_Hunter: hmm..so if I buy EA game from retail outlet, I am basically fucked!.

EULA isn't mentioned on the box when you buy the game, its mentioned inside* the box. Since one cannot open the BOX before buying it, its a fucking farce.
Again, I can't speak for other countries, but here if you have a ToS/General terms and conditions, people have to be able to read them before purchasing the product or be made aware of them.

Here's a nice read about a Dell EULA and people not being able to agree to it: http://www.cypherpunks.ca/dell.html

Pangaea666: It's EA. You should always be concerned and always vigilant.

The solution is simple. Don't buy ANYTHING from them.

Heretic777: Its been nearly 10 years since I bought anything from EA. Its been pretty easy because most of their stuff is overhyped sequels (sports, racing, C&C, movie license, etc). They remind me of Big Brother (IBM during the 80s against Apple). They want to suck every last dollar from the gamers pockets. They didn't want competition for their Madden franchise, so they paid top dollar to the NFL for exclusive rights and only they are allowed to make NFL games. I'm sure they did the same with FIFA, Formula1, PGA, Nascar, etc. Very nasty tactic.
Indeed. It's the same with FIFA too. For example, Football Manager cannot use proper competition names because EA have exclusivity deals. So instead of Premier League there is Premier Division, instead of Champions League there is Champions Cup, etc. It's a ridiculous tactic. Not unlike Microsoft who buy up everybody who can compete with them. something obviously went 'wrong' with Google. Maybe they will turn into the next Microsoft, certainly some disturbing developments.
