I don't get it, the judge did agree with the record companies but still didn't want to force charges?
Exactly - cited "poor implementation on Ireland's part of EU directives"....another reason the UK should stay the hell away from that mess.

Basically, big music industry won the case, but lost it on a technicality. Really depressing news when they win something so important on such flimsy and suspect methods of proof.
I'm stuck with Eircom that does implement the three strikes rule and not because they lost in court but because they were asked to. If I could get UPC I would in a heartbeat.

It's more complex than that, I think one of the major ISPs started giving out subscriber information even though they weren't required to, then another ISP said there was no way in heck they'd do the same.

I know one ISP in France is turning over names as required by HADOPOI but refusing to notify subscribers as they aren't required to do that. The catch is, if the subscribers aren't notified they can't be disconnected by HADOPOI. I'm probably oversimplifying but you can dig up details if you're so inclined.
