I guess it depends on which box you are talking about. I know for certain that my copy Gothic 2 had a CD check.

If you're looking for DRM-Free digital versions you should check out ShinyLoot. Last time I was there (it's been a few months) they were available DRM-Free and should still be unless they switched over to Steam keys.

Edit: Be warned that their download speed is rather slow though.
