It would be really cool if gog galaxy included some form of scumVM so that we could run our old point and click adventures through the same client we run the new ones (and some of the oldies if you rebuy them from gog).

There are already a bunch of GOG games compatible with ScummVM. Many of them are listed here: https://www.gog.com/mix/games_compatible_with_scummvm
Not just compatible, the games include ScummVM so GOG is already providing what the OP is asking for.

(btw, I'd like the original dos games)
I'm guessing they're not using SCUMMVM because of possible copyright issues in the future? the original SCUMM should still own by lucasfilm games. but SCUMMVM is under GPL and that might have other issues like this.

But they're using ScummVM in select games like Sam & Max Hit the Road.

GOG uses both ScummVM and DOSBox where appropriate. It all depends on which one works better for the given game.

I've noticed more recently added games (such as Toonstruck) default to scummvm while gsmes that have been here longer don't even if scummvm is superior to dosbox for that game.

ScummVM is rarely superior... There are a few engines with added features, but there are also plenty of examples where ScummVM's support is still bad compared to DOSBox. Lure of the Temptress and KQ1 are good examples, both of them have somewhat broken music in ScummVM.
To be honest, I'd prefer it if GOG defaulted to DOSBox or at least included the original .exe file so that we have the option of running them in DOSBox. It's pretty easy to add games to ScummVM if you prefer it, but without the .exe we don't even have the option of using DOSBox.

Complying with the GPL is pretty easy. You just have to do it.

Compared with other licensing or contractual negotiations, the requirement are trivial. You provide the source in the download, or you provide a .tar of it on your website and include a url in the download.

The situation that happened with Atari is pretty similar to one where when making a game they just illegally used some code from another company they found and did not license it or work out a contract for the use of it. The difference is that it's quite easy to correct by providing information to your users of "hey, the gpl software in this product is availble at this url", where with misappropriation of typical code, the correction is being sued for millions of dollars. The only reason this was difficult to do for Atari is that:
* They were doing boxed software, where changing it later is difficult
* They were linking the code fairly directly with other code they don't want to share

GOG.com is in an easy position to satisfy the GPL, doing the ScummVM packaging themselves, so they can just provide the information and URL in the installer and/or an accompanying textfile. Problem solved.

In the worst case, if an error is made, they can update the packages to come into compliance by providing a url in the package and providing the scummvm source on their domain / CDN.

I've not had any audio issues with LOTT in ScummVM under Debian. Maybe it's your settings?
