Copyrights to a computer game (as well as rights to other types of works) expire in Poland 70 years after publication (or from the author's death, if the game was published by the author). After this period, the work becomes a part of so-called public domain (not sure a proper English term) and can be freely copied - so GOG can release the game.

The rule in the US is similar, but corporations can own rights and renew copyrights thanks the that ridiculous mouse and his ilk lobbying to get copyrights changed and extended because of course they would.
