Well, when I saw the new Resident Evil 7 posted there right after it was cracked, their status as a "preservation" site is as iffy as most abandonware sites. And they do not remove these things even after it is reported to them...

Rixasha: archive.org has a special status but they stretch it quite a bit. Almost certainly beyond what it's good for. I don't remember exactly but I think their legal theory went something like the software is their collection/exhibit that you can check out but it remains theirs and doesn't become yours when you do. And since no ownership changes hands, they're not improperly distributing it.

Probably because suing a library over fair use is almost certainly a difficult uphill battle. Archive.org is also legally a non-profit organization so expect a counter-suit for their attorney fees which they are very likely to win if you lose.

As an example look at Cambridge University Press, Oxford University Press, and Sage Publications vs Georgia State University. The case is still ongoing through appeals but the publishers have been losing - badly. So far the decisions have been against them and they must pay all of the attorney fees for GSU.

Pretty sure most companies don't want battling a library as the hill they choose to die on.
