I haven't seen that before, looks interesting. Considering Nintendo still sells their NES games on VC, I'm not sure how that's legal, but the FAQ claims it is because, "by playing you are renting a copy of the games we own."

They also have Sega and Atari games. They even have DOS games, and not shareware versions, either.

I have, or had, a nice NES rom but this site runs much nicer and is way more user friendly than your average emulator.

"It's legal because we think it's legal" has cost a lot of people a lot of money over the years. If Nintendo objects, then there will be a suit and we will find out whether it's legal or not.

I wonder if that means they have a copy for each rental instance. In other words, if they have 2,000 people renting Mario Karts, do they have 2,000 copies / licenses? Or are they just skating by on a single licensed copy? I would think the former is okay, and the latter not so much.

I'm pretty sure it doesn't work like that legally speaking, as they would have to have a deal with Nintendo first in order to rent the games. Though I must admit I don't have an inkling how renting business works in the states, I'd still assume the rights holders would have be part of the deal as well.
Unless they actually have a deal with Nintendo or other rights-holders, the only way I can see this being even remotely legal is if they have an actual NES (or RetroN 5, I guess) hooked up for each copy to somehow stream to and take input from a logged in user -- so that a single copy is used by a single user, and that the copy used is actually a licensed cartridge rather than being a ROM file -- and that they're not taking any payment for the service.

I quite doubt either is the case here.
