If I run on DX9 vsync gets 60FPS. on DX 10 I get 24FPS. is there a ini. I can set this at? Also still no 1080P on the series? Thanks in advance.

I'm sorry that you didn't get an answer earlier. The game doesn't let you choose the refresh rate, it does that automatically, choosing among available refresh rates for your monitor, and sometimes makes a bad choice. Actually it looks like it chooses the lowest refresh rate available. You say you got 24 FPS so I guess you're using your 24Hz-capable TV as a monitor ?

You can get a higher frame rate by disabling vsync, but maybe it will get too high then...
