Interplay won :)
I wonder how the hell they managed to win...
The judge probably played all the Fallouts, then played FO3 and was like "WTF is this shit" and when they got into court he was like "GTFO"
What!? No way!
*Googles it*
Holy crap, it's true!
I love how on the front page GOG are advertising Fallout again, but with the tagline "3 games - $5.99 each".
Why ever not "Fallout Trilogy"? Seems like you have a legal right to :P
J/k, your current wording is wise in the circumstances.
After Morrowind I began hating Bethesda. I'm happy they lost out, Bethesda is going the way of Valve and ditching values for money as soon as they find an opportunity to double their money. Why are good game companies going bad left and right? Blizzard was first to fall with WoW, then Valve with L4D2, Bethesda, well, they have been slipping slowly downhill in the past 5 years or so now.
I have a theory of game-dev critical mass. As soon as a game company gets enough popularity and money and get to a certain size, X, they begin pumping out EA-Style sequels and spin-offs for pure profit over art form because when you get a taste for money it's like a fox getting a taste of eggs, they crave it the rest of their lives.
When a company reaches X and produced game sequel Y (Y=1 is first game, new series, 2 second game, 3 3rd game and so on) then we get the equation X*Y=Z Dollars. Quality is not in the equation friends, just money and sequels and money-grabs.

I hate Bethesda more than anyone but Blizzard makes games of the highest quality. Say what you will about WoW, it's by far the best available game for that genre and all the expansions have released years worth of additional content. Starcraft II looks as though it will match the quality, if not exceed that of their previous games, and while it may seem sketchy they're releasing it as 3 games from what I've seen the size of them is so massive that it's justified. Don't get me started on Diablo 3, I'm just really hoping to be done grad school before that comes out
Blizzard is a touchy subject. I am also waiting on Starcraft 2, and it is looking to be good and balanced. But the planned release of it seems sketchy to me too. WoW, well that is preference. To me, my favotire MMORPG is Entroipia universe where you can put in $10 a month and have tons of fun in a sci-fi universe but that's another whole discussion. Diablo 3 I can't tell yet if it's shaping up to be any good, them reusing the barbarian seems to be a play on our good memories. My past experience is telling me that SC2 and D3 will be massively underwhelming with that effect amplified by the massive and unneeded amount of time we are waiting for the games to be released. I'm not pre-ordering anything from Blizzard and that's the only fact I have right now, the rest is theories and ideas based on the past.
Oh and I'm still glad Bethesda lost :)
Lets just hope Interplay doesnt f*** it up again and make another over the head shooter O.o.... If that happens I hope someone beats Interplay over the head for f*cking up once again
( Yes I am a huge fallout fan, but most of my blame goes to interplay who SOLD out the series)
"The plaintiff said because of the alleged trademark infringement, consumers have become confused between the makers of the pre-existing Fallout games and Bethesda's more recent Fallout 3 -- a situation that Bethesda wanted to avoid."
Anyone who actually knows that a Fallout 1&2 exist will also know that Fallout 3 is made by a different company... its pretty common sense to any gamer. Still, i'm glad Interplay won the suit

No shitting sherlock? ;) :P In reality they wanted people to forget that original RPG trilogy ever happened so people would not compare them to Beth's shooter that is labeled Fallout 3.

You fail to take into account that people are really really really stupid. Or at the least, Bethesda thinks they are.
Well if you read "trilogy" you usually think "part 1,2 and 3".
Anyway, glad interplay won.
I am kinda sad Interplay got that. Although I was under the impression that they are suing over the rights to the MMO...
Ok. I see now.
However I do see where the validity is for Bethesda suing over the Fallout 3pack by Interplay.
I don't think they would have stopped all forms of Fallout 1, 2 and Tactics from being sold(they would want money still from them for the fact that they own it,) but furthering the distinction between the three pack and an actual trilogy. Yes I know the thought of people being Stupid and not knowing differences in how the game looks but moms , dads, aunts, uncles and grandparents do have a tendency to not look at stuff when buying and think to themselves "Well Johnny said he wanted Fallout 3."( I worked for a game store for several years) and trilogy does normally mean 1,2 and 3. lqtm
So I don't really blame Bethesda for the additional part in the law suit about the infringement.
It is well within their right to sue over this.
So I will stand with my thought of being kinda sad that Interplay won...
