Is the game abandonware? There seem to be some other sites that sell it not GOG such as the one below.

NEVER deal with Ubisoft until it disconnects its games from its abhorrent client and ONLY if its games are DRM-free.

just found this gem again, just like heroes III but in beautiful. Unfortunately I had to buy it on steam. what a shame ;)
