if I may make a suggestion, it would be to take the "no mods" issue to Runic's forums.

they have an entire section for game support on their forums, but not a single post in it about this GOG release.

my guess is that this issue is less of GOGs fault and more of Runic sending them a shitty version of the game; they probably just hacked out the DRM and figured that it would work without testing to see if adding in mods would set of some broken code that tries to access the now non-existant DRM.
Its not GOG's fault man. Responsibility belongs to the publishers and developers.
Ultimately this is GOG's concern and they need to be the ones taking the initiative to fix it. This is because as things stand the version of Torchlight that GOG is selling is inferior to every other version currently being sold. If GOG wants to see any meaningful continued sales of Torchlight then they need to be very concerned about this fact, and put considerable effort into getting things fixed ASAP.
Might as well contact both parties. I hope they do the right thing eventually, regardless of who carries the blame.
I found this topic on Runic forums:

I got a email from GOG saying they are aware of the problem and will put up a patch to fix it.
RUNIC gave GOG the executable, then GOG apparently made a mistake in modifying it . You cannot blame RUNIC for GOG messing up.

Not true.

The original steam version of Torchlight also had issues with mods not working. It was fixed at a later date.
