I went to reinstall this game today and found that the EULA says this at the beginning:
CONFLICT: DESERT STORMTM
LICENCE AGREEMENT AND LIMITED WARRANTY

Did someone swap in the wrong EULA?

The game's title is surely wrong, but the License Agreement is probably correct.
In 2005 SCi (Sales Curve Interactive) Games, which published Conflict: Desert Storm, bought and merged with Eidos Interactive, Thief's publisher. In 2009 Eidos Interactive became part of Square Enix.
So Square Enix is now the owner of both games' rights, as you can see in their store pages, and that's why I'm saying that the License Agreement is correct anyway.
