Staredown: There are probably also contract issues with GoG doing this, because this is such special preorder content. Unless their agreement specifically covers this, GoG is probably wise to err on the side of not going through legal shenanigans.
Prcisely, that's what i meant with "factor in distribution", GOG can't unilaterally decide to enable content that is disabled in the files they get from publishers/ip holders. They could, but like you say, it could come back to haunt them.
