Incorrect. Duke3D can be downloaded on abandonware websites. But not legally. Apogee/3D Realms still own the rights, and those sites aren't licensed to be providing copies of the game.
Abandonware is not a legally defensible position. It's just a tradition among the Internet.
yeah, Duke was never abandonware.
Gog is selling it so that 3D Realms can feed their children tonight. Not so that cheeky little pirates like yourself can download DN3D for yourself.

I gotta add that 3D Realms is still selling it through their distribution service (had to buy a copy few months ago).
3D Realms never stopped selling Duke Nukem 3D.

me being a professionnal game developper (and just so you know, I've already bought 6 games on GOG), it's kinda funny you're calling me a pirate... ;-)
I just found out it wasn't abandonware : although it's available on my favourite abandonware websites, but i just figured out it was the demo version.. duh !should have checked more seriously, my bad !
abandonware != legal
Abandonware as a term is load of bull anyway. Just because a publisher or a developer refuses to do a reprint of their old games, it doesn't you can go and download illegal copies of it.

If it's the case that they asked for permission, then the game isn't abandonware, it's free.

But they still distribute games they haven't asked permissions for -- that lowers their creditability to zilch.
He might be confusing "Publicly Released Source" with "Abandonware". Duke's Source has been public for years but its data files haven't - so you could have the game but not the content. Levels, creatures, etc.
