when i try to log in on the toon has a thing pop up to make a new char so as far as i understand they deleted my account.is there anything i can do to get my account back and hopefuly my iteams. also is there anything i can do or download to protect me from this happening again?

You have stated several individual problems, none of them clearly.

First, combat in town is impossible without cheating, and if I recall correctly, is quite difficult to do against a non-cheating player even when the attacker has cheats. The game ignores attempts to cast combat spells, and I think also ignores player-vs-player damage while in town. The only way I can see to kill a non-cheating player in town would be if the attacker could corrupt your character in memory, forcing your current health down to 0.

Second, characters are stored locally. The presence or absence of an account on the server has no impact on the character. If your account on the server was deleted, you can make a new one and continue using your existing character. If your character was deleted locally or was corrupted, you may need to restore it from backup, but you can continue using it with the existing account on the server.

You can avoid problems by not playing in games with people who use cheats to attack you.

well first off i was useing the shop with gris didnt notice his lvl was 127 next thing i new was a fire wall was laided down and i was dead. i remember my friends talking about this backin the day and they all stoped playing.second the only thing i had download was diablo 1 no cheats found all my gear legit so dont assume i was cheating. well he forced me out the game that i made but after he killed me i saw my lvl was 0 when i got force out the game befor i could grab all my gear i had no char picture when i went to the lobby. then when i logged out and went to log back in had my name but i had to pick a class then make new pass and such. it was corruped and i didnt have any back up or saves didnt even know i could untill after that happen. and it was a open game i tend to drop iteams that are half decent in town for people to use if they join. sorry was trying to help people and got screwed over perrty much.

But it also dont really matter now since it happen i pretty much stoped playing. why would i want to play a game where they cant even stop this kind of stuff

Griswold has no level, and no legitimate character can have a level less than 1 or greater than 50. Attempts to cast Fire Wall in town should fail and provoke an error message about "<name> cast an illegal spell" or similar. I don't recall the exact wording, but the game hasn't permitted town-casting of most spells since v1.03. Healing, Heal Other, and maybe a few harmless things are permitted. Notably, teleport is not, even though it is not offensive.

I never said you were cheating. I doubted that you could have been killed in this way at all, because I know of no way for a non-cheating player to have been killed like this. The character corruption is also new. I do not recall reading of any exploits that could corrupt a character as you describe, though given Diablo's generally vulnerable nature, I can't rule out that someone eventually found a way.

The absence of a picture in the lobby is normal for a character with an invalid level (9.4 Character icons, page 161).

Blizzard never made an effort to secure Diablo. They made numerous attempts to secure Diablo 2. During the early days, they made such a big deal of how well they had secured it that they tempted fate and were repeatedly shown to have made mistakes.

Sadly, Diablo is very hackable, even online. I'm sorry that your character got corrupted - that would be enough to make me not want to play again. But the vast majority of the online community is above all of that, so I hope you won't let this completely turn you off of the game.

For the future, I recommend always keeping a backup of your character - this is a good practice anyway since the game does have the habbit of corrupting saves every now and then even without cheaters. If you open the Diablo installation directory, you should see files labeled "multi_0.sv" The multi_#.sv files are your online characters. Just copy/paste the file elsewhere for safe keeping.

In all my years playing Diablo, I never had a character corrupted by random game bugs. As best I can recall, I never had a character corrupted by malicious players either, though I tended to keep to private games with trusted players, rather than use public games, so my opportunities to encounter malicious players were very limited.

yeah was his name meh just not feeling it ike i was really liked the game till then now its like blah dont feel like doing it yeah but cant make friends if your in private games all teh time

Don't ever play in Battle.net. Use LAN and play private games with buddies.
