I installed and ran this just fine on my Windows 10 PC that was upgraded from Windows 7.
I gave it to my son, who installed it on his Windows 10 PC that was upgraded from Windows 8.1. Unfortunately it didn't run on his system at all. It would get to the episode selection dialog, but wouldn't do anything after an episode was chosen.
After lots of searching, I fount that the problem was the working PC inherited DX9 from Windows 7, whereas the PC that the game wouldn't run on (upgraded from 8.1) did not. To resolve the problem, I downloaded the DX9 end-user redistributable June 2010 from Microsoft (not the end-user runtime... that won't install on Windows 10), installed it, and ran the DX setup executable. Once I did that everything worked.
