Second hand sales do not create new copies and is something that you have a right to do as owner of your copy or license. I'm sure you don't want that to change and would have to give a company money whenever you sold a car or book or whatever.
But with new age technology, nothing's stopping you from legally creating a backup of that game, legally selling it back to Gamestop, and keeping your technically legal backup, thus creating a copy.

What's more, with a little work, your 360/PS3/Wii can even PLAY that legal backup!

Anyways, this is off-topic, so this is the last thing I'm posting about that.

Psyringe: I wouldn't recommend trying to give a GamersGate account to another person. Trading accounts is not supported and may get you into trouble.
But what are they going to do? Delete your account?

johnki: Ironic that the only differences between piracy and secondhand game sales at places like Gamestop is that the company selling secondhand games gets to profit without giving the rightsholders any money (before anyone argues this: many a company have said they don't make a cent on secondhand sales, and that's the whole reason the "EA Online Pass" thing was conceived), and do so legally.

Seriously, I think secondhand game sales at Gamestop might actually be higher in number than copies pirated for most of those games.

It's more touchy with DRM-free digital goods, because nothing would prevent you from keeping a copy before passing along the account to someone else (the temptation would be too great for many), but I think passing along an account in your will should be cosher (you can't keep a copy for yourself, you're dead).

I'm not stating this from the standpoint of our current legal framework, but basing myself on common sense (upon which our legal framework ought be built if it wants to be respected).

Games lacking a necessary server component (which the creators of the game must be willing to maintain) to function are really sold as a product, not a service and ought to be treated as such.

Again, common sense.

For the will part, you can silently pass the account info (email info, password, etc) to someone in your will (don't explicitly state it, just request that some letter with the relevant info be passed along to whoever you want to give the account to and request that the letter should only be opened and read by them) and they can't do jack shit to stop you, that's what you can do.
