The biggest announcement in GOG.com's history is a fact! Electronic Arts grants access to its deep back catalogue of classic franchises via yours truly GOG.com!

In a ground-breaking, earthshaking, and jaw-dropping deal we've managed to sign with EA and will be releasing more than 25 legendary classics from the globally renowned publisher. With today’s announcement three widely known and much awaited brands get the revival treatment from GOG.com: Wing Commander: Privateer, Dungeon Keeper and Ultima Underworld 1+2.

We will be adding more than 25 titles from EA over the next few months, so the games will be unveiled gradually, but we can already reveal that the next upcoming titles from this huge deal are: Crusader: No remorse, Sid Meier's Alpha Centauri and Magic Carpet.

While the agreement between Electronic Arts and GOG.com brings back many acclaimed and well known franchises, it doesn’t include the much anticipated System Shock or Syndicate series at this time. After releasing the first six Electronic Arts classics, we will take a break from the concentrated awesome until later in the summer.
I support GOG.
With that said, I think that any addition is a GOOD addition.
...now when will you have Dark Earth available? :}
I wish they would put The Sims 1 Complete collection.

naomha: Why no System Shock or SS2? How about Clive Barker's Undying? COME ON!!!!
Unlike the expansion issue, GOG has been very clear from the beginning on that one. They can't sell System Shock here because they can't get the rights to do so. They made clear that they have no prospects to change that, so people shouldn't get their hopes up. My understanding is that EA doesn't even have the rights, and they obviously can't sell what they don't have.

EA does indeed still own the franchise rights to SS and SS2. They have never sold it or gotten rid of it, or considered it abandonware. Sooooo, GoG could by chance get the right to re-release it, if EA would consider it.
According to the Wiki, "On January 9, 2006, GameSpot reported that Electronic Arts had renewed its trademark protection on the System Shock name,[62] leading to speculation that System Shock 3 might be under development.[63] Three days later, Computer and Video Games reported a reliable source had come forward and confirmed the title's production. Electronic Arts UK made no comment when confronted with the information.[64] PC Gamer UK expanded these rumors further, stating the team behind The Godfather was charged with its creation.[65] Ken Levine, when asked whether he would helm a third installment, replied "that question is completely out of my hands."[66] He expressed optimism at the prospect of System Shock 3,[67] but was also very critical of Electronic Arts' attitude towards development of the game.[68][69] As of January 2010, nothing conclusive has been reported regarding the status of the purported project"
I think the way it works is that EA can make System Shock 3 if they want but the rights to SS1 and SS2 are split with other companies.

Well, just dowloaded SS2, patched it up, running Win7 patch w/ Rebirth and SHTUP mods. Game is as sweet as ever. Took a little bit of time to install everything, but why did I remove this off my HDD again?

Owning the System Shock IP is not the same as owning the rights to a particular game. Just look at the Bethesda / Interplay Fallout situation if you need an example. Bethesda didn't just lease the rights to the Fallout IP, they bought them. They control the development of any future Fallout titles. However, they do not control the rights to distribute the originals; those remained with Interplay.

It's my understanding that EA is in a similar situation regarding the System Shock rights. I don't really know System Shock though, so I'm just going on what I've heard. Whatever the exact reason is, GOG has made very clear that they won't be getting access to them. They don't just come out and say "not likely" on very many titles, so you would expect that the ones they do have some kind of special issues.
EA owns everything when it comes to the SS license. They own the IP and the distribution rights. All of it.
Doesn't really matter, because EA has chosen to sit on this IP for years midst a sea of people that would love to see the series continued further. Ken Levine and Irrational created Bioshock to try to satiate that appetite. As awesome as Bioshock was, a System Shock it was not. I'm simply saying, that if EA would release the rights to GoG to re-release this game, I truly believe the sales alone would knock everything else on the website out of the park. EA, I'm sure, has reasons of their own for not releasing this IP in some format or another over the years. It's just sad that a game with a following as huge as any hasn't seen any love at all. And GoG saying "not likely" does not mean "never". It may be hard, but hell, I'll pull for them. With the new community made XP, Vista and Win7 patches, it's not a difficult game to install or play anymore outside of Win9x. In fact, downloading the patches was the most difficult part (and I'm being sarcastic).
If GoG never gets the chance to re-release this, oh well. The fact is that SS1 and 2 are readily available on the net, and with the new patches, this timeless classic can be played by anyone yearning for a bit of classic goodness.

That contradicts what I've heard here, so I went and and did a couple quick Google searches. Most of what is out there agrees that some insurance company got part of the rights when the developer folded. Of course, most of what is out there doesn't actually amount to very much, so I take it with a grain of salt.

I will say though that the lack of information on the subject should be a bit of a wakeup call. System Shock may be revered in the classic games community, but the classic games community is just not that large. I'm sure the System Shock series would be among the best sellers on here, but that doesn't amount to as much as you seem to think.

Yes, the lack of care shown for older games by both gamers and developers is truly depressing. Imagine Hitchcock movies just being left to rot on 35mm filmstock because no one cared to re-release them on modern formats.
doing some quick number check. In 1999 the game sold about half a million. Since then, Over 1.7 million sold. Not too shabby a number for an "underground" hit, and that is not even including all the .warez sites that distribute it freely. One warez site has the downloads in the past year at over 40k. 40,000 downloads for a game over 10 years old. Not too shabby if I say so myself.

INCORRECT.

EA owns part of the rights, but an insurance company called Meadowbrook owns the other half.

Back in the day, Warren Spector split the rights between EA and Looking Glass so both of them would have to cooperate to make any future games in the series. When LG went out of business, those rights defaulted to an insurance company. Here's a quotation from the man himself when he was asked about a potential Shock 3:

"Unfortunately, the rights to System Shock trademark and copyright are both up in the air. I feel so guilty I actually negotiated the deal that said Electronic Arts owns the trademark and Looking Glass owns the copyright. My thinking was it would force us to be married so it never would be that either party should be able to say we own that, we’re making the next game, screw you. What happened was, when Looking Glass went out of business some insurance company or something ended up owning the copyright to SystemShock while EA still owned the trademark and so now, I literally don’t think anyone knows who owns what rights anymore. But if anyone is going to do it, it’s probably going to be EA and I don’t work for EA. The rights are very confused."

So no, EA does not own "everything" when it comes to System Shock, and this is why those games are not on GoG, I'm sure EA and GoG would love to release those games, but it's going to take some serious legal kung-fu.

Educated and researched. Thanks. Although, by reading the 2nd article, it does seem that EA could indeed resurrect the franchise if they wanted. I'm sure the EA lawyers could make magic happen if they really wanted it to. Legal mumbo jumbo is all in a days work over at EA.

It's not that easy though.....and dude, we get that you want SS so much(as we all do to a degree) that you're willing to ignore all logic and reason, but have patience lad. The best is yet to come, after all. :)
